Measures for the Management and Services of Foreign Teachers in Jiangxi Institute of Fashion Technology (Revised)

ChapterGeneral Provisions

Article 1 In order to strengthen the management of foreign teachers (hereinafter referred to as foreign teachers), thesemeasures are formulated in accordance with the relevant regulations of the Ministry of Education of the People's Republic of China and the Bureau of Foreign Experts of the People's Republic of China, and in line with the actual situation of the University.

Article 2 The management of foreign teachers shall focus on the University's open and professional approach to education, the construction and development of key majors, disciplines and research directions, and the continuous optimization of the quality of foreign teachers in order to strengthen the construction of the teaching staff, promote the improvement of teaching and research, improve students' foreign language proficiency, develop students' international vision, and create an international atmosphere for school running.

Article 3 The basic principles of the management of foreign teachers are: strict validation of the ideological and political content, requiring excellent ideological and political quality, excellent business ability and strong sense of responsibility, multiple recruitment, merit-based hiring, hiring according to the law, strengthening management, using their strengths and seeking effective results.

ChapterManagement Functions


Article 4 The management of foreign teachers is under the unified responsibility of theInternational Exchange Department, with the following specific duties.

(1) To coordinate the management of foreign teachers in general, to be responsible for the recruitment of foreign teachers, to organize the recruitment assessment and contract signing of foreign teachers, to handle the procedures for foreign teachers to come to China, and to approve the issuance of foreign teachers' salaries.

(2)Responsible for educating foreign teachers on foreign affairs discipline, promoting China's laws and regulations and the school's rules and regulations to foreign teachers, strictly requiring them to abide by Chinese laws and teach in accordance with the law.

(3) Protect the legal rights and interests of foreign teachers and ensure that foreign teachers enjoy the same rights as domestic staff during their time at school.

(4) To coordinate and evaluate the teaching management of foreign teachers by the public teaching departments and other teaching units, and to ensure the effectiveness of the employment of foreign teachers in our university.

Article 5 The teaching, research and living management and welfare payment of foreign teachers shall be done by theInternational Exchange Department, the Office of Human Resources, the Office of Academic Affairs, the Department of Public Instruction, the Office of Logistics and Asset Management and other functional departments in cooperation with each other.

ChapterEmployment

Article 6 Conditions of employment

In principle, foreign teachers must be under 60 years of age, be in good health, have no history of major diseases, have no criminal record or bad habits, adhere to the four basic principles, firmly implement the educational policies of the Party and the State, and be aware of national laws and regulations on foreign affairs; professional foreign teachers must have a professional master's degree or above and relevant work experience; language foreign teachers must have a bachelor's degree or above, with priority given to those with work experience in language training related to foreign education. The foreign teachers must have a bachelor's degree or above, with priority given to those who have experience in language training related to foreign education.

Article 7 Employment Procedures

(1)Each year, the Office of Academic Affairs will submit the annual demand plan for foreign teachers to the Office of Human Resources, and then to the university leaders in charge of teaching, human resources and foreign affairs, and after approval, the International Exchange Center, together with the Office of Human Resources, will be responsible for releasing information and identifying candidates. The annual demand plan for foreign teachers should include the following aspects.

1.The number of positions, job duties and business level requirements (including requirements for qualifications and knowledge and experience structure) for hiring foreign teachers.

2.The work tasks of the foreign teachers (description of teaching courses, number of teaching hours, teaching subjects, research tasks and others).

(2)The following information and materials must be provided when applying for a foreign teacher position.

1.Personal history, including detailed personal information, contact address, telephone number, email, etc.

2.Personal statement, containing reasons for applying for the post, job ideas, etc.

3.Copy of passport or, if accompanied by family members, a copy of the passport of the accompanying family member.

4.Copy of academic or degree certificates.

5.A letter of recommendation from the previous employer stating the working relationship between the employer and the candidate as well as the content and performance of the candidate's previous work; the employer's CV; for foreign cultural and educational experts already working in China, a letter of recommendation issued by the original employing unit with the official seal of the department in charge of expert work.

6.Other alternative information: medical examination certificate issued by the medical institution designated by China's foreign embassies and consulates; a certificate of no crime issued by China's foreign embassies and consulates; a copy of personal insurance policy; a teaching certificate or relevant professional and technical certificate.

(3)International Exchange Departmentwill select the candidates who meet the application requirements by means of information review, work experience survey, oral interview by telephone or video interview, etc.

(4)International Exchange Departmentwill organize relevant teaching units, the Personnel Office, the Academic Affairs Office and representatives of serving foreign teachers to conduct interviews, telephone interviews, video interviews and lectures for those who meet the recruitment requirements, issue comprehensive assessment opinions, and make specific recommendations on the proposed candidates, work assignments and remuneration packages.

(5)International Exchange Departmentwill submit the final appointment candidates and the proposal to the competent university leaders for approval. After approval, the contract can be negotiated and the appointment procedures can be carried out.

ChapterRemuneration and Treatment

Article 8 The University shall implement a contractual salary system, and the specific work tasks shall be subject to the contents stipulated in the business contract. The University shall conduct regular work appraisals for foreign teachers and issue salaries to those who pass the appraisals on time.

Article 9 Foreign teachers who meet the requirements for appointment are encouraged to teach in our school for a long period of time, and their contractual salary will be increased according to their annual work evaluation, as appropriate, during the renewal period.

Article 10 If a foreign teacher voluntarily undertakes workloads beyond those stipulated in the contract, the standard of allowance for each job and the manner of payment shall be agreed separately.

Article 11 Salary shall be paid for twelve months from the date of arrival to the date of expiry of the contract. The last month's salary during the appointment shall be paid after the foreign teacher has completed the formalities for leaving the school and paid all kinds of fees.

Article 12 Foreign teachers shall pay personal income tax in accordance with the provisions of the Personal Income Tax Law of the People's Republic of China, and the method of payment shall be withheld by the school in accordance with the relevant regulations.

Article 13 The accommodation arrangements for foreign teachers shall be as stipulated in Article 30 of these Measures.

Article 14 The university shall purchase five insurance policies in China for foreign teachers (excluding their accompanying family members) who have been employed for more than one academic year; foreign teachers who have been employed for less than one academic year shall purchase their own overseas medical insurance before coming to China.

Article 15 Foreign teachers (excluding accompanying family members) who have been employed for more than one academic year may be reimbursed for their international and domestic travel expenses by the University upon the expiry of their contracts each year with a receipt. For foreign teachers from Europe, the United States, Australia and Africa, the total amount of reimbursement shall not exceed RMB 8,000, and for foreign teachers from Asia, the total amount of reimbursement shall not exceed RMB 4,000; for foreign teachers who are employed for one semester or more but less than one academic year, the total amount of reimbursement shall not exceed RMB 4,000 for foreign teachers from Europe, the United States and Australia, and for foreign teachers from Asia, the total amount of reimbursement shall not exceed RMB 2,000.

Article 16 Foreign teachers who are employed for more than one academic year are entitled to the same welfare benefits as members of our university's trade unions.

Article 17 Foreign teachers will also participate in the annual comprehensive assessment of our staff, and the university will commend and reward foreign teachers who have made outstanding contributions to the university.

Chapter 5 Contract Management

Article 18 Foreign teachers who are employed for a period of one academic year or more are required to sign employment contracts, business contracts and management contracts with the university. The International Exchange Center shall be responsible for organizing the signing and filing of foreign teachers' contracts, as well as coordinating and supervising the implementation of the contract contents.

(1)The employment contract must be a framework contract printed by the State Administration of Foreign Affairs and signed by the International Exchange Centre on behalf of the university and the foreign teacher employed, including the period of appointment, salary, basic duties of both parties and liability for breach of contract.

(2)The business contract shall be drawn up by the relevant teaching unit and signed with the foreign professor employed in accordance with Chapter 6 of these Measures, covering the responsibilities of both parties in terms of business.

(3)The management contract shall be drawn up by theInternational Exchange Departmentand signed with the foreign teachers employed in accordance with the main contents of these Measures, and the contents shall include the relevant management regulations to be observed by the foreign teachers.

Article 19 The business contract and the management contract shall be the main basis for the implementation of contract management of foreign teachers in the university, and shall also be the reference data for the business assessment and comprehensive evaluation of the work of foreign teachers.

Article 20 According to the relevant regulations, the employment contract of foreign teachers shall be signed in principle once a year. Once the contract is signed, the relevant teaching units shall treat them as employees of their own units and manage them, and in case of breach of contract, they shall promptly inform theInternational Exchange Departmentfor coordination.

Chapter 6 Business Management

Article 21 The business management of foreign professors is the responsibility of the leader in charge of foreign affairs work, who is equipped with a contact person for foreign professors in daily management, a student assistant in life, actively looking for cooperative teachers for foreign professors in business, trying to provide assistance for foreign professors in teaching, scientific research, life and organization of activities, and ensuring that "requirements are clear, management is effective, information is smooth and services are in place" for foreign professors.

Article 22 When signing a business contract with a foreign teacher, the employing unit shall specify the number of weeks of work required of a one-year foreign teacher in each academic year, including classroom teaching: 24 hours/week, extra-curricular activities: 2 hours/week, academic lectures: 1 time/academic year, and participation in discussions and exchanges of experience in the relevant teaching unit.

Article 23 The relevant teaching units shall, according to the business expertise of foreign teachers, organize their participation in extra-curricular activities such as staff training, business consultation, foreign affairs publicity, text editing, bilingual curriculum development, foreign language website construction, foreign language corner activities, student appointment tutoring and competition guidance, and assist the university and the employing units in expanding external cooperation and exchange.

Article 24 The relevant teaching units shall fully explore the scientific research abilities of foreign teachers, encourage foreign teachers to publish academic papers in the name of the employing unit's staff, assist foreign teachers in declaring scientific research topics, and use the resources of foreign teachers to carry out academic research exchanges and cooperation.

(1)They can declare scientific research projects and teaching research projects within the university and participate in major scientific research projects (except for projects with special scientific research security requirements).

(2)In addition to completing the teaching and research tasks within the contract, foreign professors are also entitled to research awards.

Article 25 The relevant teaching units shall be responsible for introducing the situation of their units and clarifying specific business and requirements to foreign professors before they take up their posts, strengthening contact and communication with the foreign professors themselves after their arrival, and organizing regular work exchanges.

(1) explain to the foreign teacher the composition of the teaching unit concerned, its professional settings, scientific research work, business requirements, etc.

(2)inform foreign teachers in a timely manner of the school calendar arrangements, official holiday transfers, classroom arrangements, classroom distribution and relevant information about the school.

(3)Invite and request foreign teachers to participate in teaching and research activities and listen to their opinions and suggestions.

(4)encourage foreign teachers to have normal and friendly interactions with teachers and students in their own units, and actively help them solve problems arising from their work.

Article 26 The relevant teaching units shall combine open guidance and standardized management to manage the teaching of foreign teachers.

(1)Before the start of each semester, foreign teachers are introduced to the training programmes and curriculum systems of the courses taught, the main contents, teaching objectives and target groups of the courses offered are clarified, and the syllabus and model plans, necessary reference materials and teaching supplies are provided.

(2)Effectively organise the teaching cooperation between the foreign teachers and the cooperating teachers to ensure that their teaching is effectively integrated into the teaching system of our school and that the business level of the cooperating teachers is improved at the same time.

(3)Encourage foreign teachers to prepare new teaching materials, syllabuses and teaching plans on their own, but require foreign teachers to submit them before the start of classes and use them only after they have been validated and approved.

(4)To collect, archive and make use of educational materials related to foreign teachers in the long term, and to cultivate new courses or high-quality courses based on the full absorption of foreign teachers' quality teaching experience, teaching contents and teaching methods.

Article 27 Foreign teachers shall conscientiously fulfill their duties as teachers, do a good job in teaching and research, and accept the work inspection and supervision organized by the university and relevant teaching units.

(1)Foreign teachers are required to organize their teaching in strict accordance with the relevant requirements, prepare their lessons carefully, and write and submit their syllabus, teaching plans, lesson plans and other various teaching materials on time.

(2)Foreign teachers are encouraged to introduce advanced teaching experience and teaching methods from abroad and to introduce the use of quality foreign language materials, but they are not allowed to teach content unrelated to teaching in the classroom in the name of teaching.

(3)Strengthen student attendance and classroom management, assign and mark homework assignments carefully, complete relevant assignments, marking and grade registration as required, and fully complete the work requirements for extra-curricular activities.

(4)Pay attention to grooming and appearance, do not leave late or leave early and do not miss class without a reason. Leave of absence due to illness or business must be fulfilled in advance with the appointing unit for leave of absence and class transfer procedures.

(5)Do not take up part-time work outside the university without permission. If you need to do so, you should submit a written application to theInternational Exchange Departmentand ensure that your part-time job does not affect your normal work at the University.

Article 28

The religious beliefs of foreign teachers shall be respected, but they shall not be permitted to engage in religious propaganda activities. General presentations in teaching involving religious background and knowledge of the relevant sectors should not be regarded simply as propaganda of religion. In the event of disagreements over political views in teaching, they should be handled appropriately, distinguishing between different situations and natures, in order to resolve conflicts and eliminate hidden problems. My views should be stated positively, explained and care taken to safeguard the interests of the country and the school in the process of friendly interaction with foreign teachers. We should refute deliberately offensive and provocative political issues and report them promptly to the School's Foreign Affairs Office and the Head of School.

Article 29 TheInternational Exchange Departmentshall, in cooperation with the Office of Academic Affairs and relevant teaching units, conduct multifaceted inspections and evaluations of the business performance of foreign teachers (including part-time foreign teachers), and use the results as the main reference basis for the renewal of foreign teachers' appointments, rewards and salary increases.

(1)Each semester, the Academic Affairs Office and teaching supervisors shall conduct the same teaching inspection for foreign teachers as for domestic teachers; the relevant teaching units shall organise peer teachers to listen to and evaluate lectures and comprehensive assessment of students, to gain a comprehensive understanding of foreign teachers' teaching and students' learning, and to provide analysis and feedback to foreign teachers; they shall issue satisfaction survey forms, student evaluation forms, teaching quality evaluation forms, daily lecture attendance records forms and comprehensive assessment forms for submission to theInternational Exchange Department.

(2)Each semester, theInternational Exchange Department, in collaboration with the relevant teaching units, shall register the participation of foreign teachers in extra-curricular activities using the extra-curricular activities evaluation form and conduct relevant surveys and evaluations.

(3)Within one month before the expiry of the contract, the teaching unit concerned shall evaluate the effectiveness of the foreign teacher's employment based on his/her comprehensive performance, fill in an evaluation form to theInternational Exchange Departmentand give an opinion on the renewal of his/her employment.

Chapter 7 Management of Daily Life

Article 30 After the foreign professors arrive at the university, the Office of Logistics and Security and the Office of Asset Management will arrange for them to move into the university guest house. When foreign professors move into the guest house, theInternational Exchange Departmentwill assist them in the check-in procedures (receiving the flat keys, confirming the list of flat supplies, etc.).

(1)The flat provided by the university is a two-room apartment (with kitchen and bathroom), equipped with basic furniture, air conditioning (including heating equipment), colour TV, refrigerator, bedroom and simple kitchenware and internet. If the foreign teacher has other requirements for the flat, the costs incurred should be borne by the foreign teacher.

(2)For foreign teachers employed for a short period of time, if housing arrangements must be made, theInternational Exchange Departmentshall submit an application and, after approval by the head of the university in charge, the Office of Logistics and Security and the Office of Asset Management shall coordinate the arrangements according to the housing situation.

Article 31 The Office of Logistics Security and the Office of Asset Management shall inspect, repair and improve all kinds of furniture and home appliances in the flat before the foreign teachers move in, and do a good job of hygiene and cleaning before moving in. When foreign professors move in, they shall be accompanied by someone to explain and explain how to use the equipment in the flat and the precautions to be taken. When foreign teachers leave the school, someone will check whether the furniture in the flat is missing or damaged.

Article 32 If foreign professors have any requests for maintenance or are dissatisfied with the services and facilities after moving into the flats, they should bring them to the attention of theInternational Exchange Department, which willbe responsible for coordinating with the Logistics and Security Office and the Asset Management Office to solve the problem.

Article 33 The Security Office shall be responsible for the security of the on-campus dormitories, and the Office of Logistics and Security, the Office of Asset Management and theInternational Exchange Departmentshall cooperate to complete the work. The Office of Logistics and Security shall conduct regular security checks on the on-campus and off-campus dormitories, and do a good job in fire prevention and theft prevention and other security work.

Article 34 Foreign teachers shall abide by the following regulations when staying in their flats.

(1)They shall not change their flats privately, nor shall they lend or rent them to others.

(2)Pay attention to water and electricity conservation. The school will provide a free amount of RMB 300 yuan for water, electricity and gas in the flat, and any overspending must be paid for by the school, which will be deducted from the salary.

(3)Keep the flat in a hygienic condition and do not move or damage the facilities in the flat at will; if they are lost or damaged due to personal mismanagement, you will be required to pay compensation.

(4)Before the foreign teacher leaves the university at the end of the contract, the employing unit should send someone to assist him/her to go through the check-out procedures (checking the facilities and returning the keys, etc.) at the Office of Logistics and Asset Management.

(5)Keep your apartment quiet and avoid making loud noises to avoid affecting others' work or rest; if there is noise caused by friends' gatherings, please coordinate with your neighbours in advance to unite them and avoid conflicts.

(6)In order to ensure the personal and property safety of foreign teachers, the normal meeting time for all visitors is from 8:00 to 23:00 every day; if foreign visitors need to stay in the flat for a maximum of one week, they should report to theInternational Exchange Departmentand only after approval and registration of accommodation according to the relevant regulations can they stay overnight; Chinese guests cannot stay overnight in the foreign teachers' dormitory.

(7)Pay attention to fire and theft prevention and beware of accidents. If any situation occurs, please report to theInternational Exchange Departmentimmediately; for major accidents, please report to the police.

Article 35 Upon the arrival of foreign teachers, theInternational Exchange Departmentshall send someone to assist them to go through all kinds of check-in procedures on campus and get familiar with the campus environment and the surrounding living environment.

Article 36 TheInternational Exchange Departmentshall organize corresponding festivals and fellowship activities for foreign professors, invite them to participate in various recreational and sports activities for teachers and students on campus, and arrange some holiday tours according to their wishes to enrich their spare-time cultural activities.

Chapter 8 Entry and Exit Management

Article 37 TheInternational Exchange Departmentis responsible for applying to the relevant departments at higher levels for the approval of foreign professors.

(1)Only after the foreign teachers have formally signed a work contract with the university can they apply to the provincial education department for a work permit to come to China and a visa notification letter from the authorized unit.

(2)Within 7 days of arrival at the school, the foreign teacher must go to the local police station to apply for temporary registration as a foreigner.

(3)After the foreign teacher arrives at the university, theInternational Exchange Departmentwill apply for the visa, health certificate, insurance and other procedures related to residence in China for the foreign teacher, and the school will pay for the handling fee incurred.

Article 38 TheInternational Exchange Departmentis responsible for reporting the basic information and entry and exit status of foreign teachers to the Security Office, which will be responsible for submitting them to the relevant higher authorities for record.

Article 39 If a foreign teacher leaves the university or travels out of the country to visit his or her relatives during his or her teaching period, he or she should submit an application to theInternational Exchange Department, reporting the reason, destination and return date, and after approval, complete the class transfer procedures and report to theInternational Exchange Departmenton the day of his or her return. Anyone who leaves the university without permission will be regarded as having breached the contract.

Article 40 After a foreign teacher terminates his or her contract with the university (no renewal or termination for breach of contract), theInternational Exchange Departmentwill withdraw his or her work permit and require the foreign teacher to cooperate in providing a passport and have his or her work permit changed accordingly.

Article 41 Foreign professors shall leave the university within 10 days after the termination of their contractual relationship with the university. Before leaving the university, they shall go to the relevant departments of the university to complete the departure formalities, return their flats, pay all kinds of fees and return borrowed materials, etc.

Article 42 Foreign teachers shall leave the university within the validity period of the visa or residence permit applied for by the university for their departure, and those who overstay their visa or residence permit will constitute illegal residence and have to bear the relevant penalties from the immigration authorities.

Article 43 After leaving the University, if a foreign teacher needs to take up a job in another organization in China, he/she may provide theInternational Exchange Departmentwith a new employment certificate and apply for an extension of the visa and residence permit or apply for a change of the visa and residence permit on his/her own.

Article 44 If a foreign teacher loses his or her passport or residence permit, he or she should report the loss to the International Exchange Center in a timely manner, and then theInternational Exchange Departmentwill assist him or her in obtaining a replacement at his or her own expense.

Article 45 The university provides transportation services for foreign teachers employed under the program upon their arrival and departure. When foreign teachers arrive and depart, the employing organization will send someone to pick them up.

Chapter 9 Comprehensive Management

Article 46 Foreign teachers are required to receive pre-job training organized by theInternational Exchange Departmentand relevant departments before they start work, the main contents of which are

(1)relevant Chinese laws and regulations, such as the Law on the Administration of the Entry and Exit of Foreigners and religious policies

(2)cultural differences, local customs and habits.

(3)basic school operation and basic information related to teaching and living on campus.

(4)the relevant regulations of our university regarding the management of foreign teachers.

Article 47 Foreign teachers shall abide by the laws, regulations, guidelines, policies and relevant provisions of China and respect the customs and habits of our people; they shall not propagate religion or develop a congregation in any form in teaching places or other public places, and shall not conduct activities with inciting contents or endangering the security of our country in the form of investigation or other forms.

Article 48 In order to strengthen the identity management of foreign teachers, foreign teachers are required to wear the university emblem and participate in major university-level meetings and activities as required, and use business cards with the same logo and the university's online platform as tools and channels for work communication.

Article 49 In addition to the statutory holidays in China, foreign teachers may apply to theInternational Exchange Departmentfor sick leave and personal leave, as follows.

(1)Foreign teachers taking sick leave shall present a certificate from a doctor of a hospital designated by the university. If the sick leave is less than 30 days, the salary will be paid as usual. If the leave exceeds 30 days, the University has the right to terminate the contract.

(2)If a foreign teacher takes a leave of absence with the consent of the appointing party, his/her salary will be deducted on a daily basis. Within the contract period of one year (one academic year), the total number of days of personal leave shall not exceed 10 days. The leave of absence may not exceed three consecutive days. If a foreign teacher is absent from work without the consent of the appointing party, and is absent from work for one day, three days' salary shall be deducted, and if he/she is absent from work for three days, he/she shall be treated as having breached the contract and shall pay a penalty for breach of contract.If the circumstances are serious, the school has the right to terminate the contract.

Article 50 Foreign professors may participate in the recruitment and management of foreign professors, the expansion of foreign exchanges, and the guidance of teaching and scientific research in our university by applying for part-time staff positions, etc. The remuneration shall be negotiated separately.

Article 51 Foreign professors who demonstrate outstanding performance in the recruitment and management process will be subsidized, commended and rewarded through various means.

Chapter 10 By-laws

Article 52 The right of interpretation of these Measures shall be vested in theInternational Exchange Department.

Article 53 These Measures shall be implemented from the date of publication.
